Inheritance and Property Given as Gift (Hiba)

Kya farmate hain ulmaiy deen k. Meri walida (M) ka ek khita makan tha. Hum (3) bhai aur (4) bahhein, ek ka biyah walid ki hayatmae ho gaya tha. Doorsi jaidad faroqt hone k baad doosri ka biyahwalid k inteqaal baadhua--as jaidad mae sirf bade bhai ye kahkar k muhje is makan mae hissa ha woh jaidad (zameen) muhje dedo. Walida (marhooma) k kahne parhamne dast banderi kerli.

Phir is khitta makaa ka ek hissa farooq karken aur kuch unhen jahez maede kar biyah kardiya gaya. Aesa baad choti bahaan k biyah walida (m) phir makan ka ek hissa farooq kar k karna tha. Hum dono bhai aqrajat utha kar biyah kar diye aur faroqt ova hahe diya.

Walida (M) apna hayat mae kah deen k ab ye makaam dono bhaiyon ka hai, ek partition unhoon he gift deed mere naam kardi (1987 mae) jo baad mae mai he apne bete k naam transfer kar di. Badi bahan halaat ki bina per hamare ghar rahne aagaye aur koi 40 saal mustafeed hote rahe, hama he doosre hissoun ka kinaya bhi unhem de diya.

Ab huma isa faroqt karne ka faisla ka dhike. Barahe karam batayen kya hamen koi hissa bahnon ko dena chahiye? Agar haan toh kitna? Az rue shara batakar manuhoonva mashkool karem.

Question 2: 

Mere (2) ladke aur (2) ladkiyan hai aur ek rafiq safar. Kya mere is matroke mae yeh hissa darhonge? Mai kaise taqseem karooh?

الجواب وباللہ التوفیق 

  • When your mother during her lifetime gave her house to the two sons as a gift (given that this house was not from your father’s inheritance) and the sons actually took possession of this gift, it will now be considered the sons property and will not be included in her estate for the division of her inheritance.
  • If you want to perform the division of your wealth among your children during your lifetime as a gift, then there has to be equality in this division. However if you want write a will which specifies this division after your death, then specifying such a will is not correct as the Islamic Shari‘ah has specified the division for the heirs and their respective entitlements.
