Confidential Fatwa Request - Talaq E Raji

May Allah (SWT) preserve you for the Deen.

Unfortunately I recently (3 weeks ago) issued my wife with a Talaq e Raji ie. one revocable (my first) divorce. I had full intention and still have full intention to reconcile during the 3 months.

Two days after issuing the Talaq, i revoked the Talaq by sending her a message which she has confirmed that she has received
My wife however was hurt and moved in with her brother and has not wanted to have anything to do with me since

Two days after issuing the Talaq, i revoked the Talaq by sending her a message which she has confirmed that she has received and has discussed the fact that I did tell her that I revoke the divorce with 2 people (an elderly independent Muslim couple whom we both trust). I have also told her brother.

I wish to obtain your Fatwa on the following:
I have clearly revoked the Talaq after 2 days. Does my wife have to agree to reconcile in order for the revocation (raji) to be valid. ie. Is my nikah still valid if after 3 months if she does not come back to me or does not want to reconcile?

الجواب وباللہ التوفیق

Since you have clearly revoked “announced rujoo’a”, your revocation has taken effect. Approval of your wife or her coming to you is no more necessary. She is back into your “nikah” now.

رجعتہا شاہدین نحو أن یقول لہا راجعتک أو راجعت امراتی۔ (الفتاویٰ الہندیۃ ۱؍۴۶۸

وإذا طلق الرجل امرأتہ تطلیقۃ رجعیۃ أو تطلیقتین فلہ أن یراجعہا في عدتہا رضیت بذٰلک أو لم ترض، لقولہ تعالیٰ: {فَامْسِکُوْہُنَّ بِمَعْرُوْفٍ} من غیر فصل، ولا بد من قیام العدۃ؛ لأن الرجعیۃ استدامۃ الملک، ألا تری أنہ سمی إمساکًا وہو الإبقاء۔ وإنما یتحقق الاستدامۃ في العدۃ؛ لأنہ لا ملک بعد انقضائہا۔ (الفتاویٰ الہندیۃ ۱؍۴۷۰)
