Assalamulaiakum Respected Ulemaa,
My paternal grandfather passed away when my father was alive. At the time of my paternal grandfather's death, no inheritence was divided. My father passed away without receiving any inheritence during his lifetime. My paternal grandmother passed away after my father and no inheritence was divided. I would like to know, what is the rightful inheritence according to Islam for myself, my mother, and my brother and 2 sisters?
I am the eldest son of my deceased father, I have one brother and two sisters. And my mother is also alive. My deceased father has 3 sisters who are alive and each of them also have children. Please explain clearly what is each of our rightful share of inheritence in this circumstance.

This issue is related to manaskha, therefore, we reccomend that if convenient please contact a local darul-ifta, which will be better in this situation. Furhtermore, please clarify to the darul-ifta the details of all the heirs present at the time of the death of the deceased (your grandfather and your father) so the inheritance could be distributed correctly.

میرے دادا کی وفات ہویَی اس وقت میرے والد زندہ تھے ۔میرے دادا کی وفات کے وقت جائیداد کو تقسیم نہیں کیا گیا۔ میرے والد اس وراثت میں سے کچھ حاصل کئے بغیر انتقال فرما گئے ۔ پھر میری دادی میرے والد کے بعد فوت ہوئیں مگر کوی جاییداد نہی تقسیم ہوئی ۔ میں یہ جاننا چاہتا ہوں کہ اب ان تمام مرحومین کی وراثت کو میرے، میری ماں، میرے بھائی اور میری دو بہنوں کے درمیان کس طرح تقسیم کیا جائے گا؟
میں اپنے مرحوم والد کا سب سے بڑا بیٹا ہوں، میرے ایک بھائی اور دو بہنیں ہیں، اور ہماری والدہ الحمد للہ حیات ہیں۔ مرحوم والد صاحب کی تین بہنیں ہیں جو بقید حیات ہیں، اور ہر ایک کے بچے بھی ہیں۔ براہ کرم تفصیل سے جواب دیجئے کہ کن ورثاء میں کتنا کتنا حصہ آئے گا۔

چونکہ یہ مسئلہ مناسخہ کا ہے اس لئے سہولت ہوتو کسی دار الافتاء سے رجوع ہوجائیں ،یہ بہتر رہےگا،نیز مرحومین کے انتقال کے وقت ان کے مکمل موجود وارثین کو وضاحت کردی جائے تاکہ میراث صحیح تقسیم کی جاسکے۔
