Fatwa Answer

Question ID: 739 Category: Dealings and Transactions
Marriage and Rukhsati

Assalam O Allaikum,

I need a fatwa on letter head with Ulama's signature and seal for the below question. Could you please help me provide this by scan pdf copy.

Question: What is the meaning of Rukhsati under Islamic law. If the marriage is not consummated because husband and wife live separately until Rukhsati is formally done will this affect their marriage status under Islamic Law. If Rukhsati is delayed until bride completes her education and groom joins her in a different country after the immigration process is completed, will the marriage status remain valid even if the marriage is not consummated?

Jazakallah Khair,

الجواب وبالله التوفيق

The term Rukhsati means the bride going to the groom’s house and starting to live with her husband after the Nikah has been officiated. If the rukhsati has not taken place it does not invalidate or have any effect on the Nikah and the Nikah remains intact.
