Assalamu aleykum. I have a question. If a husband told his wife’s mother, “She is unable to satisfy me intimately, and I do not want to live with her,” and then left for more than 10 months without providing financial support, and no contact does divorce happen automatically? We have been separated for 11 months. He does not accept my khula and refuses to give talaq.
It should be noted that merely living separately from one’s spouse, regardless of how long the separation lasts, does not terminate the marriage. A marriage ends when the husband gives Talaq, when Khula takes place by mutual agreement, or when the marriage is annulled through a valid Shar‘i process of Faskh al-Nikah.
Therefore, in the situation described, since the husband has not given Talaq either verbally or in writing, no Khula has taken place, and the marriage has not been annulled through Faskh al-Nikah, the marriage remains valid and both parties are still Islamically considered husband and wife.
If the husband neither fulfills the marital rights of his wife, nor agrees to give Talaq, nor agrees to Khula, then the influential and respected members of both families should try to resolve the matter. If the issue cannot be resolved through these efforts, the parties should approach a Darul Qadha (Islamic judicial body) and seek a resolution to the matter.
