Respected Mufti Sahib,Assalamu Alaikum wa Rahmatullahi wa Barakatuh, There are a few questions regarding Hajj for which I require detailed, evidence-based answers:
1. Are Makkah Mukarramah, Mina, Muzdalifah, and Arafat considered one settlement? Is staying and moving between them counted as one continuous stay? For example, if someone stays in Makkah for ten days and then remains in Mina, Muzdalifah, and Arafat for five days, will he be considered a traveler or a resident?
2. After reaching Makkah Mukarramah, a person performed Umrah (for Hajj Tamattu‘). There are more than two weeks remaining until the 8th of Dhul-Hijjah. During this time, he traveled to Taif by taxi. Upon returning, is it necessary for him to enter Ihram for Umrah again from the Miqat, or can he enter Makkah without Ihram?
3. A person who has come for Hajj usually performs Qurbani every year in his hometown. Now he has been staying in Makkah Mukarramah for about three weeks before Hajj and will also perform the Qurbani of Hajj Tamattu‘. Is he also required to perform his regular annual Qurbani in Mina, or will the Qurbani of Hajj Tamattu‘ be sufficient?
محترم حضرت مفتی صاحب السلام علیکم ورحمتہ اللہ وبرکاتہ حضرت حج کے متعلق چند سوالات ہیں ان کے مدلل جوابات درکار ہیں ۔
1. کیا مکہ مکرمہ منی و مزدلفہ اور عرفات ایک ہی بستی ہے ان میں آنا جانا اور قیام ایک ہی شمار ہوگا ،مثلاً دس دن مکہ میں رہ کر پانچ دن منی و مزدلفہ اور عرفات میں ٹھہر کر مسافر رہے گا یا مقیم ہوگا۔
2. مکہ مکرمہ پہنچ کر عمرہ ادا کیا )حج تمتع کا (آٹھ ذوالحجہ تک دو ہفتہ سے زیادہ وقت ہے بذریعہ ٹیکسی طائف چلا گیا، آیا واپسی پر میقات سے عمرے کا احرام باندھنا ضروری ہے یا بغیر احرام کے بھی مکہ مکرمہ میں داخل ہو سکتے ہے۔
3. حج پر آیا ہوا شخص ہر سال اپنے مقام پر قربانی کرتا ہے مکہ مکرمہ میں حج سے پہلے تقریباً تین ہفتہ سے ٹھہرا ہوا ہے اب اس نے حج تمتع کی قربانی کرنی ہے، آیا اپنے مقام پر رہتے ہوئے ہر سال جو قربانی کرتا ہے وہ بھی یہاں منی میں کرنی پڑے گی یا حج تمتع کی قربانی کافی ہو جائے گی۔
- There is a difference of opinion among the scholars regarding this issue. The majority of Darul Ifta bodies, as well as our position, is as follows:
- Makkah Mukarramah, Mina, Muzdalifah, and Arafat are considered separate places. Therefore, if someone stays in Makkah for ten days and then stays in Mina and other places for five days, he will be considered a traveler.
- If a person intends to return to Makkah Mukarramah from Taif, it is necessary to enter into Ihram. It is not permissible to enter Makkah without Ihram.
- If the pilgrim possesses the required nisab (wealth threshold) and is considered a resident, then the Eid al-Adha sacrifice (Qurbani) will be obligatory separately. The sacrifice of Hajj Tamattu‘ will not be sufficient. However, he has the option to perform the Eid Qurbani either in Mina/Makkah or in his home country.

الجواب و باللہ التوفیق: اس مسئلہ میں علماء کے درمیان اختلاف ہے۔ اکثر دارالافتا اور ہمارا موقف اس سلسلے میں یہ ہے کہ
- مکہ مکرمہ اور منی و مزدلفہ اور عرفات الگ الگ ہیں لہٰذا اگر کوئی دس دن مکہ میں اور پانچ دن منی وغیرہ میں ٹہرے تو مسافر شمار ہوگا۔
- طائف سے مکہ مکرمہ آنے کا ارادہ ہو تو احرام باندھنا ضروری ہے بغیر احرام کے مکہ آنا جائز نہیں ۔
- اگر حاجی صاحب نصاب ہے اور مقیم ہے تو عید الاضحیٰ کی قربانی الگ سے واجب ہوگی ،حج تمتع کی قربانی کافی نہیں ہوگی البتہ اس میں اختیار ہے کہ عید کی قربانی مکہ منی میں کرے یا اپنے وطن میں۔

وحرُم تاخير الاحرام عنها لمن قصد دخول مكة ولو لحاجة) رد المحتار(552-551/3:
