I am writing to request information on how to proceed with a divorce. I would appreciate if you can provide information and steps, both Islamically and legally, that I need to complete. Thank you.

The best method of giving Talaq is to issue it during a period of purity (ṭuhr) in which no marital relations have taken place. One revocable divorce (ṭalāq raj‘ī) should be given—meaning a single, clear pronouncement—and then the wife should be left until the ʿiddah is completed. During the ʿiddah, the husband has the option to reconcile (rujū‘).This can be done verbally by saying “I have taken you back,” or even through physical contact with desire, such as touching or kissing, which also constitutes reconciliation and restores the marriage.
It is prohibited to give divorce during menstruation, or during a period of purity in which marital relations have occurred, or to give three divorces at once. However, if someone does so, the divorce will still take effect.
If your intention is to proceed with divorce through Darul Qaza, the form is available on the institution’s website. You should fill out the form, schedule an appointment, and visit the office. Al-Majlis Al-Shar‘i will complete the process and issue a certificate afterward.

الجواب وباللہ التوفیق : طلاق کا سب سے بہتر طریقہ یہ ہے کہ بیوی کو ایسے طہر میں طلاق دی جائے جس میں جماع نہ کیا ہو،نیز ایک طلاق رجعی دیں یعنی واضح الفاظ میں ایک طلاق دیں اور چھوڑ دیں یہاں تک کہ عدت گزر جائے اس طلاق میں دوران عدت شوہر چاہے تو رجوع کرسکتا ہے، صرف زبانی طور پر اتنا کہنے سے کہ میں نے رجوع کرلیا ہے یا شہوت سے چھونے یا بوسہ دینے سے بھی رجوع ہوجاتا ہے،اور بیوی نکاح میں واپس آجاتی ہے۔حالت حیض میں طلاق دینا یا ایسے طہر میں طلاق دینا جس میں بیوی سے صحبت کی ہو یا ایک ساتھ تین طلاق دینا ممنوع ہے، تاہم ان صورتوں میں اگر کوئی دیتا ہے تو طلاق واقع ہوجاتی ہے۔اگر آپ کا منشا ءدارالقضا ءمیں طلاق کی کارروائی کے حوالے سے ہے تو ادارہ کی ویب سائٹ پر فارم موجود ہے،فارم بھر کر اپائنمنٹ بنا کر ادارہ تشریف لائیں، المجلس الشرعی اس کی کارروائی مکمل کرے گی اور اس کے بعد سرٹیفکیٹ دیا جائے گا۔
