How to get out of a marriage

 

Asalam Alaikum

How is can get fatwa of seperation with a person who did nikkah with me, and he already married.

I knew that he married before at the time of my nikkah but he is give me proper time and all rights and as a American rule he cannot do second marriage so i want fatwa to get out from his nikkah.

Kindly reply me so i can proceed more details and get my things done as soon as possible.

Nikah (marriage) is a sacred and profound bond that not only fulfills physical needs but also carries the aspect of worship. It promotes chastity and purity, brings peace and comfort to marital life, and through it, the blessing of children is achieved — one of the reasons why the Noble Prophet expressed pride in the large number of his followers. Therefore, one should strive to uphold this relationship with kindness and sincerity and aim to achieve its noble objectives. Decisions related to marriage and separation should not be made impulsively or emotionally, but after due thought and proper investigation, so that the purpose and harmony of married life can be maintained. Divorce (ṭalāq) should not be taken or demanded without a valid reason, as doing so unnecessarily is disliked, sinful, and subject to warning. However, if there is a genuine necessity, then the following methods may be adopted: First Method: The husband may issue one divorce during a period of purity (ṭuhr) when he has not had marital relations with his wife. After that, the wife must complete her waiting period (‘iddah), which is three menstrual cycles. Once the ‘iddah ends, she is free to marry whomever she wishes. Second Method: If the husband refuses to grant a divorce, the wife may seek khulaʿ, i.e., a mutual separation by returning the mahr (dowry) if it has already been received, or by forgoing it if it hasn’t been paid. If the husband accepts the khulaʿ, it counts as one irrevocable (bā’in) divorce. It is preferable that such matters be resolved through Dār al-Qaḍha. Only Allah knows best what is correct. : نکاح ایک ایسا  عظیم رشتہ ہے   جس میں جنسی تقاضوں کی تکمیل کے ساتھ عبادت کا پہلو بھی پایاجاتا ہے،اور پھر عفت و پاک دامنی ،ازدوجی زندگی میں  سکون  و آرام اور پھر اس کے ذریعہ حصول اولاد  اور اس کے سبب نبی مکرم ﷺ کا اپنی امت کی کثرت کی بنیاد پر فخر جیسے اہم مقاصد بھی اس میں شامل ہیں ،اس لئے خوش اسلوبی سے اس رشتہ کو نبھانے کی اور اس کے مقاصد کے حصول کی کوشش کر نی چاہیے، محض وقتی جذبات کی رو میں اقدام نہ کیاجائے ،بلکہ سوچ سمجھ کر اور تحقیقات  کرنے کے بعد ہی  قدم آگے بڑھانا چاہیے کہ تا کہ ازدواجی زندگی گزارنے میں اور ان مقاصد کی تکمیل میں سہولت  ہو،   بلا ضرورت نہ طلاق لی جائے اور نہ یہ پسندیدہ ہے،بلکہ بلا ضرورت طلاق کا مطالبہ وعید  اور گناہ کا باعث ہے،البتہ اگرواقعتا مجبوری ہوتو پھر درج ذیل طریقے  اختیار کیا جاسکتا ہے۔

ایک تو یہ ہےکہ شوہر بیوی کو پاکی کی حالت میں ایک طلاق دیدے، اس کے بعدبیوی اپنی عدت  یعنی تین حیض مکمل کرلے، اس کے بعد اسے اختیار ہوگا کہ جہاں چاہے نکاح کرلے۔

دوسرا طریقہ یہ ہےکہ اگر شوہر طلاق نہ دے تو بیوی خلع لے ،یعنی اگر شوہر نے مہر ادا کردیا ہے تو اس کو  واپس کرکے یا مہر ادا ہی نہیں  کیا ہے تواس  کو معاف کرکے خلع چاہے،اگر وہ قبول کرلے تو اس سے بھی ایک طلاق بائن واقع ہوجاتی ہے۔

اس کے لئے بہتر ہے کہ کسی دار القضاء سے رجوع  کرکے اپنا معاملہ حل کرلیں۔

قال: " الطلاق على ثلاثة أوجه حسن وأحسن وبدعي فالأحسن أن يطلق الرجل امرأته تطليقة واحدة في طهر لم يجامعها فيه ويتركها حتى تنقضي عدتها " لأن الصحابة رضي الله عنهم كانوا يستحبون أن لا يزيدوا في الطلاق على واحدة حتى تنقضي العدة فإن هذا أفضل عندهم من أن يطلقها الرجل ثلاثا عند كل طهر واحدة ولأنه أبعد من الندامة وأقل ضررا بالمرأة ولا خلاف لأحد في الكراهة..
