I hope you are well.
I would like to ask for your guidance on a family matter related to a divorce oath.
Some time ago, my husband said to me words like:
“If you study, you are divorced.”
He now explains that he didn’t truly mean divorce — he only said it out of anger, wanting to stop me from studying or to threaten me. He did not intend for an actual divorce to happen.
Now he regrets what he said and wants to take back that oath so that I can study without the divorce being valid.
I haven’t started studying yet, and we would like to know:
Does divorce take effect just because he made this statement, or only if I actually start studying?
If his intention was only to prevent me from studying and not real divorce, can he make kafārah (expiation) like for an oath to cancel it?
What exactly is the correct expiation in this case?
We would be very grateful for your advice and clarification according to the proper Islamic ruling.

میں ایک خاندانی معاملے کے بارے میں رہنمائی چاہتی ہوں جو طلاق کی قسم سے متعلق ہے۔
کچھ عرصہ پہلے میرے شوہر نے مجھ سے اس طرح کے الفاظ کہے:
"اگر تم نے پڑھائی کی تو تمہیں طلاق ہے۔"
اب وہ یہ وضاحت کرتے ہیں کہ ان کا مطلب حقیقی طلاق نہیں تھا — انہوں نے یہ بات غصے میں کہی تھی تاکہ مجھے پڑھنے سے روک سکیں یا دھمکانے کے طور پر۔ ان کی نیت حقیقی طلاق دینے کی نہیں تھی۔
اب وہ اپنے اس قول پر نادم ہیں اور چاہتے ہیں کہ وہ اس قسم کو ختم کر سکیں تاکہ میں پڑھائی شروع کروں تو طلاق واقع نہ ہو۔
میں نے ابھی تک پڑھائی شروع نہیں کی، اور ہم یہ جاننا چاہتے ہیں:
کیا صرف یہ الفاظ کہنے سے طلاق واقع ہو گئی، یا طلاق تب واقع ہوگی جب میں واقعی پڑھائی شروع کروں؟
اگر ان کی نیت صرف روکنے کی تھی نہ کہ حقیقی طلاق کی، تو کیا وہ اس کو قسم (يمين) کے کفارے کی طرح ختم کر سکتے ہیں؟
اس صورت میں درست کفارہ کیا ہوگا؟
ہم آپ سے شریعت کے مطابق اس معاملے کی وضاحت اور رہنمائی کے طلبگار ہیں۔

Provided the question is correctly stated, in the mentioned case, if the husband has said the words (of divorce), even if only with the intention of warning or threatening, and not with the intention of actually divorcing, still, when you begin your studies, one divorce will take effect upon you. Since you have not yet started your studies, the divorce has not taken effect.As for how to avoid the divorce from taking place: either you do not pursue your studies, or if you do begin them, then one divorce will occur. However, in that case, the husband may reconcile (make rujoo) during the waiting period (‘iddah).Reconciliation (rujoo) can be done simply by the husband saying, “I have taken her back,” or by physical affection — such as kissing, intercourse, or touching with desire — and after that, the oath will be considered fulfilled, and studying again in the future will not cause another divorce. بشرت صحت سوال صورت مسئولہ میں شوہر نے جو الفاظ کہے ہیں چاہے ڈرانے کی نیت سے ہی کہے ہوں اور طلاق کی نیت سے نہیں کہے ہو ں تب بھی جب آپ پڑھائی کرے گی تو آپ پر ایک طلاق واقع ہو جائے گی۔ چونکہ ابھی آپ نے پڑھائی شروع نہیں کی ہے اس لئے طلاق واقع نہیں ہوئی، بقیہ جہاں تک اس طلاق سےچھٹکارہ کی بات ہے تویا تو آپ پڑھائی نہ کریں یا اگر آپ پڑھائی کرتے ہیں تو ایک طلاق واقع ہو جائے گی، البتہ اس صورت میں عدد کے اندر شوہر رجوع کر لے، محض زبان سے اتنا کہنے سے کہ میں نے رجوع کر لیا رجوع ہو جائے گا یا پھر بیوی سے بوس و کنار ،جماع اور شہوت سے چھونے سےبھی رجوع ہو جائے گا اور اس کے بعد قسم پوری ہو جائے گی ،پھر دوبارہ پڑھائی سے طلاق واقع نہیں ہوگی۔
واذا اضافه الى الشرط وقع عقيب الشرط اتفاقا مثل ان يقول لامراته ان دخلت الدار فانت طالق (الفتاوى الهندية:۱/۴۲۰)
