Asalamualaikum Wa RahMatullahi Wa Barkatuhu,
I and my wife have been trying to conceive a child for over a year without success. After undergoing medical medications and tests, our doctor identified a potential condition called endometriosis, which causes chronic internal inflammation and reduces fertility.To help us conceive, the doctor has given us two primary medical options:
MIGS Surgery: A minimally invasive surgical procedure to physically look inside and remove this inflammatory tissue.
IUI (Intrauterine Insemination): A non-surgical procedure where my semen sample is collected, washed and concentrated in a laboratory, and then placed directly inside my wife’s uterus using a small catheter at the exact time of ovulation.
Because we wish to avoid the risks and physical toll of surgery, we prefer to bypass the operation and choose the IUI procedure as our next step to achieve pregnancy.
Our Question :Is it permissible and lawful (Halal) according to the Hanafi school of thought for us to undergo this IUI procedure
The current method of assisted reproduction is, in principle, not permissible. However, if it is not possible to conceive a child through natural means, and conventional medical treatment has not been effective, and there is a strong likelihood that this method will result in having a child, then it may be permissible due to necessity.
Even then, the following additional conditions must be observed:
- The semen must come exclusively from the husband and the wife’s ovum must be used; neither may be obtained from another man or woman.
- The fertilized material must be transferred into the wife’s uterus by a female doctor, not by a male doctor.
- Proper observance of hijab must be maintained at every stage of the procedure.
- The husband’s reproductive material should be obtained through an injection where possible. If it cannot be obtained through an injection, then it should be obtained from the wife through ‘azl (withdrawal).
- There must be no possibility of the reproductive material being exchanged, mixed, or confused with that of another person.

موجودہ طریقہ حصول اولاد کے لیے اصلا نا جائز ہے، البتہ اگر فطری طریقے سے اولاد پیدا نہیں ہو رہی ہے اور عام طریقۂ علاج سے کوئی فائدہ حاصل نہ ہوا ہو اور اس طریقہ کے اختیار کرنے میں اولاد کا ظن غالب ہو تو مجبوری کی وجہ سے اس کی گنجائش ہے۔لیکن اس کے لئے بھی مزید چند شرطیں اور ہیں:
مادہ منویہ شوہر اور بیوی ہی کا لیا جائے کسی اور مرد یا عورت کا نہیں۔
بیوی کے رحم میں لیڈی ڈاکٹر ہی کے ذریعہ اس کو منتقل کیاجائے ۔مرد کے ذریعہ نہیں۔
ہر مرحلے پر حجاب کا پورا پورا اہتمام کیاجائے۔
مرد کا مادہ تولید بذریعہ انجکشن اگر حاصل ہو تو اس کو انجام دے اور اگر انجیکشن سے نہ لیاجارہا ہو تو بیوی سے عزل کی صورت اختیار کیا جائے۔
مادہ منویہ کی تبدیلی یا اختلاط کا اندیشہ نہ ہو۔(مستفاد فتاوی دار العلوم کراچی)

عَنْ الْبَحْرِ عَنْ الْمُحِيطِ مَا نَصُّهُ: إذَا عَالَجَ الرَّجُلُ جَارِيَتَهُ فِيمَا دُونَ الْفَرْجِ فَأَنْزَلَ فَأَخَذَتْ الْجَارِيَةُ مَاءَهُ فِي شَيْءٍ فَاسْتَدْخَلَتْهُ فِي فَرْجِهَا فِي حِدْثَانِ ذَلِكَ فَعَلِقَتْ الْجَارِيَةُ وَوَلَدَتْ فَالْوَلَدُ وَلَدُهُ، وَالْجَارِيَةُ أُمُّ وَلَدٍ لَهُ (شامی:۳؍۵۲۸)
