The currently prevalent methods of buying and selling gold, silver, or cash through online digital trading platforms are not permissible according to Islamic law.

This is because if gold or silver is exchanged for the same type of commodity (e.g., gold for gold or silver for silver), the parties must be present in the same transaction session (majlis al-ʿaqd), and both counter-values must be taken into possession during that same session, as required by the Prophetic hadith. In digital gold and silver trading, however, the contracting parties are not present in the same session.

If gold is being purchased with a country's currency, then such a sale is permissible only if, at the time of the contract (the transaction session), either the full payment is made immediately or the purchased gold comes into the buyer's possession immediately. It is not permissible for both the payment and the gold to be deferred.

In the commonly practiced method of online gold trading, neither is the full payment typically completed in the required manner nor does the buyer take actual possession of the gold. Instead, only a numerical entry or "reflection" appears in the buyer's account, which does not constitute possession (qabḍ) according to Islamic law.

It should be noted that constructive possession (qabḍ ḥukmī) is recognized in Islamic law only when the buyer has genuine control over the gold after the purchase—meaning the buyer can take physical delivery of it, transfer it, or otherwise dispose of it as they wish. If such authority does not exist, then it is not regarded as valid Sharʿī possession.

In the prevalent online trading model, the buyer neither takes physical possession of the gold nor acquires valid constructive possession, since the gold merely appears as an entry in the account. Moreover, in many cases the broker does not even possess the corresponding quantity of actual physical gold. If the gold does not truly exist, then possession cannot occur. This would result in selling something before taking possession of it, or selling something that does not actually exist or is not in one's possession—both of which are prohibited according to the Prophetic hadith.

Therefore, the commonly practiced method of online gold trading is not valid according to Islamic law, and it should be avoided.

 

سونا چاندی یا نقدی کی آن لائن ڈیجیٹل خرید وفروخت کی مروج تمام صورتیں ناجائز  ہیں ؛ کیوں کہ سونا  یا چاندی   کی اگر ہم جنس کے ساتھ خرید وفروخت  کی جارہی ہے تو عاقدین کا ایک مجلس میں ہونا اور عوضین پر اسی مجلس میں قبضہ کرنا ازروئے حدیث ضروری ہے، جب کہ  ڈیجیٹل سونا چاندی کی خرید وفروخت کرنے والے ایک مجلس میں نہیں ہوتے ۔

اگر کسی ملک کی کرنسی کے  ساتھ سونے کی خرید و فروخت  کی جارہی ہے تو شرعاً صرف اسی صورت میں جائز ہے جب خریداری کے وقت ہی (مجلسِ عقد) میں یا تو پوری رقم ادا کر دی جائے یا خریدا ہوا سونا فوراً خریدار کے قبضے میں آجائے، دونوں چیزیں ادھار نہیں ہوسکتیں۔
سونے کی آن لائن تجارت کے مروّجہ طریقہ کار میں عموماً نہ مکمل ادائیگی کی جاتی ہے اور نہ ہی سونا خریدار کے قبضے میں آتا ہے، بلکہ صرف اکاؤنٹ میں ایک عددی اندراج یا ’’reflection‘‘ دکھایا جاتا ہے، جو شرعاً قبضہ نہیں کہلاتا۔

واضح رہے کہ قبضہ حکمی (constructive possession) شرعاً اسی وقت معتبر ہوتا ہے، جب خریدار کو خریداری کے بعد سونے پر واقعی اختیار حاصل ہو، یعنی چاہے تو وہ سونا اپنی ملکیت سے نکلوا سکے، منتقل کر سکے یا اپنی مرضی سے استعمال کر سکے، اگر ایسا اختیار موجود نہ ہو تو وہ ’’شرعی قبضہ‘‘ نہیں کہلائے گا۔ جب کہ سونا خریدنے والا سونے پر حسی طور پر قبضہ بھی نہیں کرتا، خریداری کی صورت میں فقط اس کے اکاؤنٹ میں ظاہر کردیا جاتا ہے،قبضہ حکمی ماننا بھی درست نہیں ہے کیونکہ  اکثر اوقات بروکر کے پاس اتنی مقدار میں حقیقی سونا موجود بھی نہیں ہوتا، اور جب حقیقت میں سونا ہی موجود ہی نہ ہوتو تو اس پر قبضہ بھی نہیں ہوگا،بغیر قبضہ کے بیچنا لازم آئے گا،یا معود کا  بیچنا لازم آئے گا،جو از روئے حدیث جائز نہیں ہے،اس لئے سونے کی آن لائن ٹریڈنگ کا مروّجہ طریقہ شرعاً درست نہیں، اس سے اجتناب لازم ہے۔

"عن ابن عباس رضي اللّٰه عنهما أن رسول اللّٰه صلی اللّٰه علیه وسلم قال: من ابتاع طعامًا فلا یبعه حتی یستوفیه، قال ابن عباس: وأحسب کل شيء مثله"

عن ابن عمر، أن النبي صلى الله عليه وسلم نهى عن بيع الكالئ بالكالئ يعني: الدين بالدين. (شرح معاني الآثاررقم الحدیث: 5554)

ثم التسلیم یکون بالتخلیة علی وجہ یتمکن من القبض بلا مانع ولا حائل ․․․․․ بأن یکون مفرزاً غیر مشغول بحق غیرہ۔ (درمختار مع الشامی: 7/94، ط: زکردیوبند)

 ومنہا في المبیع وہو أن یکون موجوداً فلا ینعقد بیع المعدوم ومالہ خطر العدم ۔ ہندیة: ۳/۵۔

لو باع فضۃ بفلوس؛ فإنہ یشترط قبض أحد البدلین قبل الافتراق لا قبضہما۔ (شامي ۷؍۵۲۲ زکریا، البحرالرائق ۶؍۱۹۴)
