Islamic ruling on adopting or giving a child in adoption.

Hope this email finds you well.

I was seeking an answer for the following question(s):

Is adoption permissible in Islam?

Or giving your child up for adoption?

It is permissible to adopt a child, but the following rules must be observed:
  1. Parentage: The real parents of the adopted child will continue to be regarded as his or her true parents. The adoptive parents cannot attribute the child to themselves as their biological offspring, nor can the child consider the adoptive parents as his or her real parents.
  2. Breastfeeding (Rada‘ah): If the adoptive mother breastfeeds the child during the period of nursing (within two lunar years), then the rules of rada‘ah (fosterage) will apply — meaning that certain mahram (non-marriageable kinship) relationships will be established accordingly.
  3. Inheritance: The adopted child will inherit only from his or her biological parents, not from the adoptive parents. Similarly, the adoptive parents will not inherit from the adopted child.
  4. Mahram (non-marriageable) relations: Those who were non-mahram (marriageable) to the child before adoption will remain non-mahram after adoption unless fosterage (rada‘ah) occurs. For example, the wife of the adoptive father remains non-mahram to the adopted boy, and marriage between them would be legally valid in Shariah.
  5. Hijab (Veil) Requirement: Since the adopted child remains non-mahram, after reaching puberty, the rules of hijab and gender segregation must be observed between them.
Allah Almighty says: “Call them by [the names of] their fathers; that is more just in the sight of Allah. But if you do not know their fathers, then they are your brothers in faith and your clients.”(Surah al-Ahzab, 33:5) Sayyiduna Sa‘d (may Allah be pleased with him) narrated that the Prophet said:“Whoever claims to be the son of someone other than his real father, knowing that he is not his father, Paradise is forbidden for him.”(Sahih al-Bukhari: 6385) Only Allah knows best what is correct. بسم اللہ الرحمن الرحیم

: کسی کے بچہ گود لینا جائز ہے،البتہ درجِ ذیل امور کی رعایت ضروری ہے۔

(۱)ایک یہ  کہ گود لئے ہوئے بچے کے حقیقی والدین ہی اس کے والدین کہلائیں گے۔ گود لینے والا اسے اولاد کی حیثیت سے اپنی طرف منسوب نہیں کرسکتا  ۔اور نہ بچہ اپنےگود لینے والے کو حقیقی باپ  سمجھ سکتا ہے۔

(۲)گود لینے کے بعد مدت رضاعت میں اگر خاتون نے دودھ پلایا ہے ہے تو اس مرضعہ رضاعت کے احکام ثابت ہوں گے۔

 (۳)یہ بچہ اپنے حقیقی والدین کا ہی وارث بنے گا ، اور نہ ہی  گود لینے اس بچہ  کا وارث بنے گا۔

(۴اس بچے کے لئے جو اقارب پہلے نا محرم تھے  اگر رضاعت نہ ہو تو وہ گود لینے کے بعد بھی نامحرم ہی رہیں گے یعنی مثلا گود لینے والے شخص کی بیوی اس بچے کے لئے نامحرم ہوگی۔اس سے نکاح درست ہوگا۔

(۵) چونکہ وہ نا محرم ہوتا ہے اس لئے بالغ ہونے کے بعد اس سے پردہ کرنا ضروری ہوگا ۔

قال  اللہ تعالی: ادعوهم لآبائهم هو أقسط عند الله فإن لم تعلموا آباءهم فإخوانكم في الدين ومواليكم ( الاٰیۃ، الأحزاب: ۵)

 فدلت الآیۃ علی مسائل۔۔۔ الثانی إن الدعي  والمتبنی لا یلحق في الأحکام بالابن ؛ فلا یستحق المیراث ولا یرث عنہ المدعي، ولا یحرم حلیلتہ بعد الطلاق و العدۃ علی ذلک المدعي ، ولا عکسہ ( أحکام القرآن للتھانوی: ۱۴/ ۲۹۱)

عن سعد رضي الله عنه قال:سمعت النبي صلى الله عليه وسلم يقول: من ادعى إلى غير أبيه، وهو يعلم أنه غير أبيه، فالجنة عليه حرام۔ (رواہ البخاري، رقم۶۳۸۵)

عن أبي ذر رضي الله عنه:أنه سمع النبي صلى الله عليه وسلم يقول: ليس من رجل ‌ادعى ‌لغير ‌أبيه - وهو يعلمه - إلا كفر، ومن ادعى قوما ليس له فيهم نسب، فليتبوأ معقده من النار۔(رواہ البخاری،رقم۳۳۱۷)

قال العلامہ ابن حجرؒوفي الحديث ‌تحريم ‌الانتفاء من النسب المعروف والادعاء إلى غيره وقيد في الحديث بالعلم ولا بد منه في الحالتين إثباتا ونفيا لأن الإثم إنما يترتب على العالم بالشيء المتعمد له۔ (فتح الباری۶/ ۵۴۱، دار المعرفۃ)
