Assalamualaikum,
Can I give my wife One divorce and live together with her in the same house for 3 months? We have been having issues. I want to give it one last chance before we break our marriage.
Is this permissible?
As stated:
“Seclusion with her is disliked (tanzīhan) if he does not intend to take her back; otherwise it is not disliked. This is because seclusion may lead to touching with desire, resulting in raj‘ah even though he does not intend it, and this would cause the ‘iddah to lengthen.”
(Al-Durr al-Mukhtār with Radd al-Muhtār, 5/39, Zakariyya)
However, if the divorce is irrevocable (ṭalāq bā’in), then it is not permissible for them to live together in the same house without the presence of a third person whose presence removes the fear of temptation or wrongdoing. In such a case, it is better for the husband to leave the home; and if this is difficult, the wife may stay elsewhere.
باسمہ تعالی الجواب و باللہ التوفیق: صورت مسئولہ میں آپ مطلقہ کے ساتھ اسی گھر میں رہ سکتے ہیں بِالخصوص جب طلاق رجعی دی ہو اور آپ نکاہ میں رکھنے کا ارادہ رکھتے ہوں۔ شرعا اس میں کوئی حرج نہیں ہے البتہ اگر رجعت کا بالکل ہی ارادہ نہیں ہے تو تنہائی و خلوت اختیار کرنا مکروہ تنزیہی ہے کیونکہ بسا اوقات نہ چاہتے ہوئے رجعت ہو جائے گی اور پھر طلاق دینے کی صورت میں اس کی عدت طویل ہو جائے گی
لكن تكره الخلوة بها تنزيها ان لم يكن من قصده الرجعۃ والا لا تكرہ قال: لان الخلوۃ ربما ادت الى المس بشهوۃ فيصير مراجعا وهو لا يريدها فتطول العدۃ( الدر المختار مع رد المختار 39/5 زکریا)
البتہ اگر ایک طلاق بائن ہو تو بلا کسی ایسے ثالث کی موجودگی کے جس کے ساتھ رہنے سے وقوع فتنہ کا اندیشہ نہ ہو اس گھر میں ساتھ میں رہنا درست نہیں ہے۔ ایسی صورت میں بہتر ہے کہ شوہر گھر چھوڑے اور اگر یہ دشوار ہے تو بیوی دوسرے گھر میں رہ سکتی ہے۔
