Ruling on a House Purchased Through Mixed (Halal and Haram) Income and Accepting Gifts from Such Earnings

 

My father owns a gas station where his income comes from the sale of gas, candy, alcohol, lottery, and tobacco. His income is therefore a mix of halal and haram sources, and he himself does not know the exact percentage of each.

Recently, we purchased a house through UIF (Islamic banking). The down payment was made using my father’s money, while I pay the monthly installments/mortgage from my halal income.

My questions are as follows:

Is it permissible for us to live in this house? If not, how can we make this house halal for ourselves?
Can I accept money and/or gifts (such as a car, groceries, food, etc.) from my father, knowing that his income comes from both halal and haram sources?

Please help me by answering these questions. I sincerely seek the truth and wish to avoid any involvement—knowingly or unknowingly—in anything haram. Jazak Allahu Khayran.

الجواب وباللہ التوفیق
1) In the mentioned case, it is permissible for you to live in that house; however, it is better to exercise caution. Your father, however, is responsible for returning the portion of his income earned through haram means to its rightful owners. If that is not possible, he should give an equivalent amount in charity. (2) In this situation, you should assess whether the majority of your father’s income comes from haram sources—such as alcohol and lottery—or from other halal businesses. If it is predominantly from halal sources, then it is permissible to accept gifts from him. However, if it is mostly from haram earnings, then it is not permissible to accept gifts from him. That said, if your father gives a gift explicitly stating that it is from his halal income, and you believe his statement to be true, then in that case, it would be permissible to accept the gift. : (۱) مذکورہ گھر میں آپ کے لئے رہنے کی گنجائش ہے ؛ البتہ احتراز بہتر ہے،البتہ آپ کے والد صاحب کے ذمے  لازم ہے کہ جو آمدنی انھیں حرام طریقے سے حاصل ہوئی ہے اسے اصل مالک تک پہنچادیں اور اگر یہ ممکن نہ ہوتو اتنی مقدار صدقہ کردیں۔

 توضيح المسألة ما في التتارخانية حيث قال: رجل ‌اكتسب ‌مالا من حرام ثم اشترى فهذا على خمسة أوجه: أما إن دفع تلك الدراهم إلى البائع أولا ثم اشترى منه بها أو اشترى قبل الدفع بها ودفعها، أو اشترى قبل الدفع بها ودفع غيرها، أو اشترى مطلقا ودفع تلك الدراهم، أو اشترى بدراهم أخر ودفع تلك الدراهم۔۔۔وقال الكرخي: في الوجه الأول والثاني لا يطيب، وفي الثلاث الأخيرة يطيب، وقال أبو بكر: لا يطيب في الكل، لكن الفتوى الآن على قول الكرخي دفعا للحرج عن الناس اهـ. وفي الولوالجية: وقال بعضهم: لا يطيب في الوجوه كلها وهو المختار، ولكن الفتوى اليوم على قول الكرخي دفعا للحرج لكثرة الحرام اهـ وعلى هذا مشى المصنف في كتاب الغصب تبعا للدرر وغيرها۔ ( الدر المختار مع رد المحتار:۱۵ / ۴۴۱،کتاب البیوع، باب المتفرقات، تحقیق فرفور ،اتحاد دیوبند، الفتاوی الھندیۃ : ۳/ ۲۱۵، کتاب البیوع ، الباب العشرون، دار الفکر، چند اہم عصری مسائل۲/ ۲۵۵، مکتبہ دار العلوم دیوبند)

 (۲) صورت مسئولہ میں آپ اندازہ کریں کہ آپ کی والد صاحب کی کمائی کا اکثر حصہ شراب اور لوٹری جیسے حرام کاموں سے حاصل ہوتی ہے یا دیگر حلال کاروبار سے ، اگر غالب گمان یہ ہو کہ اکثر آمدنی حلال طریقے سے حاصل ہوئی ہے تو ہدیہ لینے کی گنجائش ہے اور اگر اس بات کا ظن غالب ہو کہ اکثر آمدنی حرام کاروبارکے ذریعہ ہوتی ہے تو ان سے ہدیہ لینا جائز نہیں ہے ؛ البتہ اگر والد صاحب یہ کہہ کر ہدیہ دیں کے یہ حلال مال میں سے دیا جارہا ہے تو آپ کو ان کی بات پر یقین ہوتو اس صورت میں ہدیہ لینے کی گنجائش ہے ۔

أهدى ‌إلى ‌رجل شيئا أو أضافه إن كان غالب ماله من الحلال فلا بأس إلا أن يعلم بأنه حرام، فإن كان الغالب هو الحرام ينبغي أن لا يقبل الهدية، ولا يأكل الطعام إلا أن يخبره بأنه حلال ورثته أو استقرضته من رجل، كذا في الينابيع.
