طلب فتوى في مسألة طلاق تلفظت بها في ظروف قهرية تحت تأثير المرض والغضب الشديد

الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد وعلى آله وصحبه أجمعين،
السلام عليكم ورحمة الله وبركاته،
إلى فضيلة الشيخ حفظه الله،
أما بعد،
فإني ألتمس من فضيلتكم فتوى شرعية بخصوص مسألة الطلاق التي تلفظت بها في حالات غضب شديد، وأود أن أضع بين يديكم حالتي الصحية والنفسية والاجتماعية والأسرية، حتى يكون الحكم دقيقًا ومنصفًا ويطمئن قلبي بما يرضي الله تعالى.
️ مدة الزواج وظروفي الأسرية
أنا متزوج منذ سنة 2006 (19 عامًا).
رزقني الله بزوجة وابن وبنت في سن المراهقة (17 و18 سنة).
كان هدفي الدائم الحفاظ على بيتي وتربية أبنائي في بيئة مستقرة.
⚕️ حالتي الصحية والنفسية
أعاني من اكتئاب عصبي، كنت أتعالج منه بدواء Ludiomil (Maprotiline) في المغرب.
لدي انزلاق غضروفي وآلام مزمنة في الظهر، اضطررت بسببها لاستخدام المورفين (Morphine) مع Duloxetine وCyclobenzaprine.
هذه الأدوية تؤثر على قدرتي على التحكم في الانفعال وتضعف الإدراك عند الغضب.
محاولاتي للتوقف عن الأدوية
حاولت مرارًا التوقف المفاجئ، مما سبب أعراضًا انسحابية (تهيّج عصبي، صداع، فقدان تركيز، أرق، وزيادة الغضب).
غير منتظم في تناول العلاج لأنه يعيق عملي كمحلل ومبرمج يحتاج تركيزًا عاليًا.
⚠️ مظاهر الغضب الشديد
حرارة في الجسد وضغط في الرأس حتى كدت أن أُغمى عليّ.
فقدان كامل للذاكرة بعد النوبات، وكأنني لم أكن واعيًا.
لم تكن لي نية الطلاق أبدًا، وإنما صدرت الألفاظ لا شعوريًا. لأن المراد لم يكن الطلاق وإنما التنفيس عن الغضب
سلوكيات غير واعية:
تجاوز إشارات المرور دون إدراك.
رمي الهاتف والأدوات بقوة.
كلمات جارحة ثم نسيانها.
نوبات بكاء أو صراخ بلا وعي.
سؤال الآخرين عما بدر مني بعد النوبة.
وهي أعراض تتوافق مع ما وصفه الفقهاء بـ"الغضب المطبق" الذي يُفقد الإنسان إدراكه.
️ الشعور بمؤثرات داخلية
أحيانًا أشعر أن شيئًا ما يتكلم على لساني عند الغضب دون تحكم.
حالة أشبه بـ"الانفصال عن الذات": أتصرف ثم أندم ولا أتذكر.
أشك في وجود تأثير (مسّ، عين، سحر) خاصة أن حياتي الزوجية كانت مستقرة ثم تدهورت فجأة.
易 سلوك زوجتي وتأثيره
زوجتي امرأة صالحة، منقبة، تحفظ القرآن، وتشارك في حلقات التحفيظ.
لكنها أحيانًا لا تراعي حالتي الصحية (تطلب مني الخروج أو القيادة رغم الألم).
تدفعني لحفظ القرآن مثلها، وتعتبر بعض السنن واجبة.
منذ أن عادت لارتداء النقاب سنة 2025:
بدأت تذهب للمسجد في أوقات متأخرة (2-3 صباحًا).
انشغلت عن الأبناء بالحلقات القرآنية عبر الإنترنت.
توترت علاقتها مع ابني الأكبر الذي تغير سلوكه كثيرًا.
المشاكل الزوجية الخاصة
منذ 2016، العلاقة الخاصة غير مستقرة.
ظهرت علامات نفور واضحة من جانبها، مما سبب لي معاناة نفسية كبيرة.
️♂️ ظروف أمنية خاصة
كنت أعمل بمؤسسة حساسة في المغرب.
بسبب نقابها، تعرضنا لمراقبة من جهاز المخابرات (DST).
اضطرت زوجتي آنذاك لخلع النقاب، وكان ذلك أحد أسباب هجرتي إلى كندا.
لكنها أعادت ارتداءه في كندا رغم معارضتي لأسباب أمنية.
نبذة عني
حريص على ديني، وعلى النظافة والنظام في حياتي اليومية.
أتحمل مسؤولياتي كاملة (الإنفاق، شراء احتياجات البيت).
أنفق بسخاء وأوازن المصاريف لصالح الأسرة.
الوضع الحالي
زوجتي غادرت كندا إلى المغرب مقتنعة بوقوع الطلاق.
لا تأخذ حالتي الصحية والنفسية بجدية.
أبنائي بحاجة ماسة لوجودها قربهم نفسيًا وأسريًا.
❓ أسئلتي لفضيلتكم
هل يقع الطلاق في مثل حالتي مع وجود الغضب الشديد وتأثير المرض والأدوية على الإدراك والنية؟
إذا كان الغضب شديد، بحيث يشتد عليّ ويؤثر على تفكيري لكن ما زلت أدرك كلامي، فهل يقع الطلاق في هذه الحالة؟ خاصة أنني علمت أن ابن تيمية وابن القيم وبعض المحققين إلى أنه لا يقع إذا كان الغضب يغلق على الإرادة ويجعل اللفظ مجرد تنفيس لا قصدًا للطلاق.
ما الموقف الشرعي من إصرار الزوجة على اعتقادها بوقوع الطلاق رغم هذه الملابسات؟
وهل يمكن أن يكون للوساوس أو السحر دور في تفريقنا؟

فتوى الشيخ ابن باز رقم 4542: الطلاق حال الغضب الشديد لا يقع إذا غيّب العقل.
قول الشيخ ابن عثيمين: "الغضب إذا أزال العقل، صار صاحبه غير مكلف، فلا يقع منه طلاق ولا بيع ولا نكاح."
تنبيه فقهي: الغضب الذي يشتد على الشخص ويؤثر على تفكيره، لكنه لا يزيل إدراكه كليًا → يرى ابن تيمية وابن القيم وبعض المحققين إلى أنه لا يقع إذا كان الغضب قد أغلق على الإرادة، لأن المراد لم يكن الطلاق وإنما التنفيس عن الغضب.
Subject: Seeking a Fatwa Regarding a Divorce Uttered Under Duress Due to Illness and Severe Anger
Bismillah al-Rahman al-Rahim
Alhamdulillah Rabb al-‘Alamin, wa al-Salatu wa al-Salamu ‘ala Sayyidina Muhammad wa ‘ala Alihi wa Sahbihi Ajma’in.
As-salamu ‘alaykum wa rahmatullahi wa barakatuh,
To the Honorable Sheikh (may Allah preserve him),
I am seeking a formal Islamic ruling (fatwa) from your eminence regarding a divorce I uttered in a state of severe anger. I wish to present my health, psychological, social, and familial circumstances to you so that the judgment may be accurate and fair, and so my heart may be put at ease with what pleases Allah Almighty.
️ Marriage Duration and Family Circumstances
I have been married since 2006 (19 years).
Allah has blessed me with a wife, a son, and a daughter who are teenagers (17 and 18 years old).
My constant goal has been to maintain my home and raise my children in a stable environment.
⚕️ My Health and Psychological Condition
I suffer from neurotic depression. I was previously treated with Ludiomil (Maprotiline) in Morocco.
I have a herniated disc and chronic back pain, for which I had to use Morphine along with Duloxetine and Cyclobenzaprine.
These medications affect my ability to control impulses and weaken my perception when angry.
My Attempts to Stop the Medications:I have tried to stop suddenly multiple times, causing withdrawal symptoms (nervous irritation, headaches, loss of concentration, insomnia, and increased anger).
I am irregular in taking the treatment because it hinders my work as an analyst and programmer, which requires high concentration.
⚠️ Manifestations of Severe Anger
Intense body heat and pressure in the head to the point of nearly fainting.
Complete memory loss after episodes, as if I was unconscious.
I never had the intention to divorce; the words were uttered unconsciously, merely to vent anger.
Unconscious behaviors:
Running traffic lights without realization.
Throwing phones and objects forcefully.
Hurtful words followed by forgetfulness.
Episodes of crying or screaming unconsciously.
Asking others what happened after the episode.
These symptoms align with what jurists describe as "overwhelming anger" (al-ghadab al-mutbiq) that causes loss of awareness.
️ Feeling Internal Influences
Sometimes I feel something speaks through my tongue when angry, without my control.
A state similar to "dissociation": I act, then regret, and do not remember.
I suspect possible influence (evil eye, magic, possession), especially since my marital life was stable but suddenly deteriorated.
易 My Wife’s Behavior and Its Impact
My wife is a righteous, niqab-wearing woman who has memorized the Quran and participates in Quran study circles.
However, she sometimes does not consider my health condition (e.g., asks me to go out or drive despite pain).
She pushes me to memorize the Quran like her and considers some Sunnahs obligatory.
Since she returned to wearing the niqab in 2025:
She started going to the mosque at late hours (2-3 AM).
She became preoccupied with online Quran circles, neglecting the children.
Her relationship with our eldest son, whose behavior has changed significantly, became strained.
Private Marital Issues
Since 2016, our intimate relationship has been unstable.
Clear signs of aversion appeared from her side, causing me significant psychological distress.
️♂️ Special Security Circumstances
I worked for a sensitive institution in Morocco.
Due to her niqab, we were surveilled by the intelligence agency (DST).
My wife was forced to remove her niqab at that time, which was one reason we immigrated to Canada.
However, she resumed wearing it in Canada despite my opposition due to security concerns.
About Me
I am diligent about my religion, cleanliness, and organization in daily life.
I fully bear my responsibilities (providing financially, purchasing household needs).
I spend generously and balance expenses for the family’s benefit.
Current Situation
My wife has left Canada for Morocco, convinced the divorce has occurred.
She does not take my health and psychological condition seriously.
My children desperately need her presence for their psychological and familial well-being.
❓ My Questions for Your Eminence
Is the divorce considered valid given my severe anger, illness, and the medications’ impact on my awareness and intention?
If the anger was severe enough to affect my thinking but I was still aware of my speech, is the divorce valid? I have learned that Ibn Taymiyyah, Ibn al-Qayyim, and some scholars held that it does not occur if the anger overwhelms the will, making the utterance merely a venting of anger rather than an intent to divorce.
What is the Islamic ruling on my wife’s insistence that the divorce has occurred despite these circumstances?
Could whispers (waswas) or magic play a role in separating us?

Juristic note: Anger that severely affects a person’s thinking but does not completely remove awareness → Ibn Taymiyyah, Ibn al-Qayyim, and some scholars held that it does not occur if the anger closed off the will, because the intention was not divorce but venting anger.

الجواب وبالله التوفيق
A divorce given in a normal state of anger does take effect. However, if the anger reaches such an extreme level that a person completely loses awareness and self-control — to the extent that he becomes like one insane, does not know what he is saying, and speaks involuntarily without intention — then in that condition, the divorce does not take effect. Therefore, if your state of anger was of that extreme degree, then the divorce you gave in that condition will not be valid; otherwise, it will take effect. It should be noted that you did not mention how many divorces you pronounced. If you gave fewer than three divorces while in full awareness, There is a possibility of reconciliation (rujoo) during the waiting period (‘iddah) — either verbally (by saying you take your wife back) or through physical intimacy such as kissing or touching with desire. And if the ‘iddah period has already passed, you can remarry her with a new nikah. However, if you have pronounced three divorces or more and were not in the extreme state of uncontrolled anger described above, then all three divorces have taken effect, and there is no possibility of revocation or remarriage unless a valid halalah occurs according to Shariah. الجواب وبالله التوفيق
إنّ الطلاق الواقع في حالة الغضب عمومًا يقع، إلّا إذا بلغ الغضب حدًّا يزول معه الشعور تمامًا، وتكون الحالة شبيهة بالجنون، بحيث لا يدري الإنسان ما يقول، ويتكلم بغير قصدٍ ولا اختيار، فحينئذٍ لا يقع الطلاق.
فإن كانت حالة غضبك قد بلغت هذا الحد، فلا يقع الطلاق في تلك الحالة، وإلا فإنه يقع.
ويُوضَح أنّك لم تذكر عدد الطلقات التي صدرت منك فإن كنتَ قد طلّقتَ أقلّ من ثلاث طلقاتٍ، وكنتَ في حالة وعيٍ وإدراك، فهناك مجالٌ للرجعة ما دامت الزوجة في العدّة، وذلك إمّا بالقول، أو بالقبلة، أو باللمس مع الشهوة، فتقع الرجعة بذلك.
وإن كانت الطلقاتُ أقلّ من ثلاث وقد انتهت العدّة، فيجوز لكما أن تُجدّدا عقد النكاح.
ويُوضَح أيضًا أنّه إن كنتَ قد أوقعتَ ثلاث طلقاتٍ أو أكثر، ولم تكن في حالة الغضب الشديد التي سبق وصفها، فإن الطلقات الثلاث
لما فی الفقہ الاسلامی :طلاق الغضبان: يفهم مما ذكر أن طلاق الغضبان لا يقع إذا اشتد الغضب، بأن وصل إلى درجة لا يدري فيها ما يقول ويفعل ولا يقصده. أو وصل به الغضب إلى درجة يغلب عليه فيها الخلل والاضطراب في أقواله وأفعاله، وهذه حالة نادرة. فإن ظل الشخص في حالة وعي وإدراك لما يقول فيقع طلاقه، وهذا هو الغالب في كل طلاق يصدر عن الرجل؛ لأن الغضبان مكلف في حال غضبه بما يصدر منه من كفر وقتل نفس وأخذ مال بغير حق وطلاق وغيرها (كتاب الفقه الإسلامي:۹/۶۸۸۲)
مطلب في طلاق المدهوش ……..قلت وللحافظ ابن القيم الحنبلي رسالة في طلاق الغضبان قال فيها انه على ثلاثة اقسام احدها ان يحصل له مبادئ الغضب بحيث لا يتغير عقله ويعلم ما يقول ويقصده وهذا لا اشكال فيه والثاني ان يبلغ النهاية فلا يعلم ما يقول ولا يريده فهذا لا ريب انه لا ينفذ شيء من اقواله والثالث من توسط بين المرتبتين بحيث لم يصِر كالمجنون فهذا محل النظر والادلة على عدم نفوذ اقواله اه ملخصا من شرح الغاية الحنبلية لكن اشار في الغاية الى مخالفته في الثالث حيث قال ويقع الطلاق من غضب خلافا لابن القيم اه وهذا الموافق عندنا (رد المحتار:۳/۲۴۴)
قال اللّٰہ تعالیٰ: {الطَّلَاقُ مَرَّتَانِ} [البقرۃ: ۲۲۹]
قال ابن مسعود ابن عباس ومجاہد وغیرہم: المراد بالآیۃ التعریف بسنۃ الطلاق أي من طلّق اثنتین فلیتق اللّٰہ في الثالثۃ۔ (الجامع لأحکام القرآن الکریم ۳؍۱۲۶ )
وأجمع العلماء علی أن قولہ تعالیٰ: أو تسریح بإحسان ہي الطلقۃ الثالثۃ بعد الطلقتین؛ وإیاہا عني بقولہ: {فَاِنْ طَلَّقَہَا فَلَا تَحِلُّ لَہُ مِنْ بَعْدُ حَتَّی تَنْکِحَ زَوْجًا غَیْرَہُ} وأجمعوا علی أن من طلّق امرأتہ طلقۃ أو طلقتین فلہ مراجعتہا؛ فإن طلقہا الثالثۃ لم تحل لہ حتی تنکح زوجا غیرہ۔ (الجامع لأحکام القرآن الکریم للقرطبي ۳؍۱۲۷-۱۲۸)
عن سہل بن سعد الساعدي أخبرہ أن عویمر بن أشقر العجلاني في حدیث طویل - فقال رسول اللّٰہ صلی اللّٰہ علیہ وسلم: أریت رجلا وجد مع امرأتہ رجلا أیقتلہ - فتقتلونہ أم کیف یفعل؟ فقال رسول اللّٰہ صلی اللّٰہ علیہ وسلم: قد أنزل اللّٰہ فیک وفي صاحبتک فاذہب فأت بہا، قال سہل: فتلاعنا وأنا مع الناس عند رسول اللّٰہ صلی اللّٰہ علیہ وسلم فلما فرغا قال عویمر: کذبت علیہا یا رسول اللّٰہ إن أمسکتہا، فطلقہا ثلاثا قبل أن یأمرہ رسول اللّٰہ صلی اللّٰہ علیہ وسلم۔ (صحیح البخاري ، رقم: ۵۲۵۹، ۵۳۰۸، صحیح مسلم ، رقم: ۱۴۹۲)
