Talaq Situation

My husband has repeatedly made verbal statements such as: “I want a divorce from you” “This marriage is done” “Consider yourself divorced” Recent weeks: “Divorce, divorce, divorce” These statements have been said on various occasions, at random times. He experienced significant personal losses: His father passed away in July 2016 and mother passed away in February 2023. I have suggested counseling, but these conversations turn into blame and defensiveness instead of productive discussion. I have also experienced ongoing emotional and verbal abuse from him towards me and children. I did not grow up in an environment like this and do not find this behavior acceptable. I am seeking your guidance on whether this marriage is legally considered a divorce or whether reconciliation is still possible given the circumstances. Clarification: The husband explained the words he said at that time as follows: “If you want me to say divorce, then I say ‘divorce’; I say again ‘divorce’; and for the third time I say ‘divorce’”. The husband stated these words in anger, and his intention was to vent his anger, not to actually give a divorce.

The husband used different statements at different times, and the ruling for each statement is as follows:

  1. “I want divorce from you”: No divorce took place with this statement.
  2. “This marriage is over”: If the intention behind this statement was Talaq, then one (Talaq Bain) irrevocable Talaq would take place, and after the completion of the (‘iddah) waiting period, the marriage would end however remarriage between the two would still be permissible, after the completion of the ‘iddah before a new marriage contract, the woman would no longer remain in the status where further divorces could apply; therefore, later divorces would not take effect. But if there was no intention of divorce with this statement,

then the later statements of divorce will be examined.

  1. “Consider yourself divorced”: If the intention of divorce existed with this statement, then divorce would occur, and after the completion of the ‘iddah, the marriage would end. The remaining details would be the same as in the previous case. However, if there was no intention of divorce, then the next statement of divorce would be considered.
  2. “If you want me to say divorce, then I say ‘divorce’; I say again ‘divorce’; and for the third time I say ‘divorce’.” The husband said these words in anger, intending only to express anger and not intending divorce: In this case, three divorces would take place even without intention, and the husband and wife would become unlawful for each other. It would no longer be permissible for them to continue marital life together. Since all three divorces have taken effect, khula (mutual divorce/separation) would also have no benefit. After the completion of the ‘iddah, the woman may marry whomever she wishes.

شوہر نے مختلف اوقات میں مختلف جملے استعمال کئے ہیں ہر ایک کا حکم درج ذیل ہے :

  1. "میں تم سے طلاق چاہتا ہوں " :اس جملے سے طلاق واقع نہیں ہوئی۔
  2. " یہ شادی ختم ہو چکی ہے" :  اس میں اگر طلاق کی نیت تھی تو ایک طلاق بائن واقع ہوگی بعد عدت نکاح ختم ہو جائے گا البتہ دوبارہ نکاح کی گنجائش ہوگی بعد عدت دوبارہ نکاح سے پہلے وہ طلاق کی محل نہیں رہے گی اس لئے بعد کی طلاقیں واقع نہیں ہوگی لیکن اگر اس جملہ سے طلاق کی نیت نہیں تھی تو بعد کی طلاق کی تفصیل دیکھی جائے گی ۔
  3. " اپنے آپ کو طلاق یافتہ سمجھو": اس جملے سے بھی نیت طلاق کی ہو تو طلاق واقع ہو جائے گی بعد عدت نکاح ختم ہو جائیگا باقی تفصیل گزشتہ صورت کی طرح ہوگی اور اگر طلاق کی نیت نہ تھی تو پھر اگلی طلاق کو دیکھا جائے گا۔
  4. کہ "اگر تم چاہتی ہو کہ میں طلاق کہوں تو میں کہتا ہوں "طلاق"، دوبارہ کہتا ہوں" طلاق" ،تیسری بار کہہ کہتا ہوں" طلاق""۔ شوہر نے یہ الفاظ غصہ میں کہے اور غصہ نکالنا مقصد تھا طلاق دینا مقصد نہیں تھا : اس صورت میں بلا نیت تین طلاقیں واقع ہو جائیں گی اور میاں بیوی ایک دوسرے کے لئے اجنبی ہو جائیں گے۔ اب ازدواجی زندگی گزارنا جائز نہیں ہوگا اور اس صورت میں چونکہ تینوں طلاقیں واقع ہو گئی تو خلع کا بھی کوئی فائدہ نہیں، بعد عدت عورت جہاں چاہے نکاح کر سکتی ہے۔
