May Allah Azwajal bless you with ajar for taking the time to give a ruling on my situation. Question is whether divorce has been established according to Sharaee jurisprudence in light of the documents I am submitting related to court dissolution of marriage.
1. Ex husband (name) application for divorce.
2. The courts dissolution of marriage ruling. I sincerely appreciate your effort. May Allah Ta’ala bless your help in clarifying the situation? Jazakumullahu Khair.
According to the documents provided in this case, the husband himself filed a petition with the court seeking the dissolution of the marriage and authorized the court to terminate the marriage. Based on this authorization, the court issued a judgment dissolving the marriage. Therefore, from an Islamic (Shar'i) perspective as well, the divorce has taken effect.
صورت مسئولہ میں دستاویزات کے مطابق عدالت کو شوہر نے خود تنسیخ نکاح کی درخواست دی اور نکاح ختم کرنے کا وکیل بنایا ہے اور اسی بنیاد پر عدالت نے نکاح کے ختم کرنے کا فیصلہ دیا ہے، اس لیئے شرعاً بھی طلاق واقع ہو چکی ہے۔
