Assalāmu ʿalaykum wa raḥmatullāh wa barakatuh
I am writing with urgency on behalf of our bereaved family. A relative of ours passed away in the recent Air India aviation tragedy. The airline is now offering compensation under the Montreal Convention, but there is confusion in our family regarding how this money should be handled in light of Sharīʿah.
This compensation is not something the deceased owned in his lifetime, nor is it exactly like diyah in the classical sense since there is no qāḍī, no guilty verdict, and no Sharʿī court procedure. At the same time, it is not a personal grant from the company, but rather a settlement payment given because of the death, and it is described in law as being for the “survivors” or “dependents.”
The deceased left behind his father, his mother, and three brothers (one of whom is blind and was partially dependent upon him). The difficulty we face is this:
Some argue that the money should be treated as the estate (tarakah) of the deceased and therefore distributed by farāʾiḍ.
Others say that because the deceased never owned it, and because the law itself allocates it to “dependents,” it should be given as intended by the airlines (survivors' family, with the amount increasing as per dependency). There would be 3 scenarios here I can think of:
Equally proportioned to all 5 family members, outside of the rules of inheritance. So 20% each
Equally proportioned to only Mother and Father, with brothers mahjub. However, equally here would signal 50/50 since they were both dependent on him
Split equally between Mother and Father and the blind brother, whose dependency the airline is aware of, and because of whom the compensation amount will likely be increased. This would mean 33.3/33.3/33.3
The family is now divided on this point, and we fear this may lead to disputes. What we require is a clear, authoritative fatwā that settles the matter once and for all, so that everyone can act with certainty and unity.
Specifically, we ask: Should this type of compensation be treated as the deceased’s estate to be divided strictly according to Ḥanafī inheritance rules, or should it be treated as a grant to survivors outside the estate? And in either case, how should it be distributed amongst the father, mother, and brothers in this scenario?
We humbly request your guidance on this as a matter of urgency, so that the family can have a reference point for any decision made in the near future.

In the matter under consideration, scholars differ regarding the compensation paid by an airline in lieu of blood money (diyah). However, the preferred (rajih) opinion is that such compensation is analogous to diyah, and therefore the rulings of diyah are applicable to it.
Accordingly, Mufti Shabbir Sahib Qasmi (may Allah preserve him) has written in response to a question on this issue:“The compensation given by the government in the case of an accidental death is considered to be under the ruling of diyah, and all heirs will have a right to this compensation, whether the government has designated specific heirs for assistance or has not made such a designation.”(Fatawa Qasmiyyah, p. 238)
Similarly, Mufti Salman Mansoorpuri (may Allah bless him) writes:“The claim received from the government due to an accident will be distributed among the heirs; it will not be the exclusive right of the wife alone.”(Kitab al-Nawazil, 30/164)
It is also mentioned in a fatwa issued by Darul Ifta Jamia Islamia Banori Town, Karachi:“In the present case, the one crore rupees received by the deceased’s heirs from the company as financial assistance will be considered part of the deceased’s estate and will be distributed among all heirs according to their Shariah-prescribed shares.”(Fatwa No. 144303101034)
However, if the government gives the amount not as compensation for blood (diyah), but rather specifies and allocates it to particular individuals, then it will belong exclusively to those individuals.

In light of these fatwas, the ruling is that the compensation paid by the airline is considered to be under the ruling of diyah. All existing heirs will be entitled to inheritance according to Shariah, except in the case where the government specifically determines and gives the aid amount to particular individuals; in that case, it will belong only to those recipients.
The method of distribution will be as follows: the amount received for the deceased, along with all movable and immovable property, will be divided into six shares. One share will be given to the mother and five shares to the father. The three brothers will be excluded from inheritance. However, if after receiving their shares, the parents wish to give something to the brothers or other individuals, they are free to do so.

الجواب و باللہ التوفیق: صورت مسئولہ میں ائرلائن کی جانب سے خون کے عوض میں دیے جانے والے معاوضہ کے بارے میں علماء کا اختلاف ہے لیکن راجع قول یہ ہے کہ اس کو دیت کے مشابہ قرار دیا ہے۔ اور اس پر دیت ہی کہ احکام کو جاری کیا ہے ،چنانچہ مفتی شبیر صاحب قاسم دا مت برکاۃ نے اس کے تعلق سے سوال کے جواب میں لکھا ہے :
حادثاتی موت پر حکومت کی جانب سے ملنے والا معاوضہ دیت کے حکم میں ہے اور اس م معاوضے پر تمام مورثاں کا حق ہوگا خواہ حکومت نے مخصوص وارثین کے لئے نامزد تعاون کیا ہو یا نامزد تعاون کا اعلان نہ کیا ہو۔( فتاوی قاسمیہ 238
نیز مفتی سلمان منصور بھوی دعوت برکاتہوں لکھتے ہیں اکسیڈنٹ کی وجہ سے جو کلیم گورنمنٹ کی جانب سے ملے گا وہ وارثین میں تقسیم ہوگا صرف بیوی ہی کا حق نہیں ہوگا۔( کتاب النو ازل: 164 / 30
دارالافتاء جا میہ اسلامیہ بنو ری ٹاون کراچی کے فتوے میں مذکور ہے کہ:صورة مسولہ میں سائل کا مرحوم کے ورثہ کوپیی ئے کی طرف سے جو ایک کروڑ بطور امداد ملی ہے وہ مرحوم کا ترکہ ہوگی اور اس کے تمام ورثاء میں شعری ح حصے کے اعتبار سے تقسیم ہوگی ۔(فتوی نمبر 144303101034
البتہ اگر حکومت کی جانب سے بطور خون کا عوض نہیں بلکہ کسی کو متعین کر کے دیا گیا ہے و اس کا ہوگا۔( فتاوی محمودیہ 547 / 24
اِن فتحاوی کی روشنی میں مسئلہ یہ ہے کہ ائرلائن کی جانب سے دیا جانے والا م معاوضہ دیت کے حکم میں ہے، تمام موجود وارثین شرعی اعتبار سے میراث کے حقدار ہوں گے، الایہ کہ اگر حکومت افراد کو خاص کر کے امدین کی رقم تیقن کر کے ان کو دیدے تو جن لوگوں کو دیا جائے وہ ان کا شمار ہوگا۔
تقسیم کی شکل اس طرح ہوگی کہ مرحوم ملنے والی رقم کے اور اس کے علاوہ کامل جائداد معقولہ و غیر معقولہ کے ۶ حصے کئے جائیں، ایک حصہ والدہ کو دیا جائے اور پانچ حصہ والد کو دیا جائیں اور تین بھائی محروم ہوں گے ،ہاں اگر والدین اپنے حصہ لینے کے بعد بھائی کو یا دیگر افراد کو دینا چاہے تو انہیں اختیار ہے۔
عن عمرو بن شعيب عن ابيه عن جده قال كان رسول الله صلى الله عليه وسلم يقوم دية الخطا على اهل القرى اربعماية دينار او عدلها من الورق يقومها على اثمان الابل فاذا غلت رفع في قيمتها واذا هاجت رخصا نقص من قيمتها وبلغت على عهد رسول الله صلى الله عليه وسلم ما بين اربعماية دينار الى ثمانماية دينار او عدلها من الورق ثمانية آلاف درهم وقضى رسول الله صلى الله عليه وسلم على اهل البقر مائتي بقرة ومن كان دية عقله في الشاء فالفى شاة قال وقال رسول الله صلى الله عليه وسلم ان العقل ميراث بين ورثة القتيل على قرابتهم فما فضل فللعصبة(سُنن أبي داود حدیث 4564)
وأما الأب فله أحوال ثلاث: ۔۔۔۔۔۔۔ والتعصيب المحض وذلك عند عدم الولد وولد الابن وإن سفل(السراجي في الميراث)
وأمّا لِلأُمِّ فأحْوَال ثَلاَث: السُدُس مع الولد أو ولد الابن وإنْ سَفَل أو مَعَ الاثنَينِ من الإخْوَة والأخَوات فصاعِداً مِن أيِّ جِهة كانا(السراجي في الميراث)
والمَحجُوبُ يَحْجِب بالاتّفاق كالاثنَينِ من الإخْوَة والأخَوات فصاعداً مِن أيِّ جِهة كانا فإنّهما لا يَرِثانِ مع الأب ولكنْ يَحْجِبانِ الأمَّ من الثُلُث إلى السُدُس. (السراجي في الميراث)
