As Salam alaykum, I was born into a Muslim family. We weren’t really practicing growing up besides fasting Ramadan and not eating pork. I got married and we did the nikkah. I ended up telling my wife after we did the nikkah that I didn’t really believe that much in god. She ended up going to civil court to do the divorce without me being there. I wanted to know was my nikkah valid since I told her that I didn’t believe in god that much after we did the contract? And if so was the divorce process done the proper way?
1. You mentioned that "my faith in Allah Almighty was not strong." What exactly did you mean by that? Did you mean that you denied the existence of Allah or any definitive belief of Islam, or did you simply mean that your faith was weak and that you had become negligent in practicing your religion?
If by "weak faith" you only meant negligence in religious practice and shortcomings in your actions, then this would have no effect on the validity of your marriage (nikah).
2. A wife obtaining a unilateral divorce solely through a civil court is not sufficient to constitute a valid Islamic divorce (ṭalāq). However, if you accepted the court's decision, signed the divorce decree, or if both spouses jointly filed the divorce petition and the court subsequently issued a decree of dissolution, then the divorce would be considered effective under Islamic law.
آپ نے جو یہ کہا تھا کہ "میرا اللہ تعالیٰ پر ایمان مضبوط نہیں ہے"، اس سے آپ کی مراد کیا تھی؟ کیا آپ اللہ تعالیٰ کے وجود یا اسلام کے کسی قطعی عقیدے کا انکار کرتے تھے، یا صرف ایمان کی کمزوری اور دینی غفلت مراد تھی؟
اگر ایمان کی کمزوری اعمال سے غفلت مراد تھی تو اس سے آپ کے نکاح پر کوئی اثر نہیں پڑے گا۔
۲۔ بیوی کا یک طرفہ محض سول کورٹ سے طلاق حاصل کر لینا شرعی طلاق کے لیے کافی نہیں ہے۔ اگر کورٹ کے فیصلہ پر آپ راضی ہوگئے یا اس پر دستخط کردی یا طلاق کی درخواست زوجین نے مل کر دائر کی اور کورٹ نے علاحدگی کا فیصلہ کردیا تو اس سے طلاق واقع ہوجائے گی۔
