Validity of Talaq Issued Under Severe Coercion, Physical Beatings, Imprisonment, and Extortion

As-salamu alaykum wa rahmatullahi wa barakatuh.
I am writing to urgently seek a formal Shariah ruling (Fatwa) regarding a complex marital situation involving extreme, actualized coercion (Ikrah Mulji'). We are seeking clarity on whether the Nikkah is still valid, as there is a sincere desire to reconcile as soon as possible.
For the sake of privacy, I will outline the events referring only to the Husband, the First Wife, and the Second Wife.
The Background & Timeline
March 7, 2023: The Husband and the Second Wife entered into a valid Nikkah. They also successfully built a company together.
February 2024: The First Wife discovered the second marriage. Extreme hostility ensued. The First Wife used her family's influence to send the police to harass the Second Wife, forcing the Husband and the Second Wife to cut off communication.
March 7, 2024: The Husband sent a recorded video to the Second Wife pronouncing Talaq. Crucially, this video was recorded and sent from the First Wife's phone number.
July 14, 2024: The Husband and the Second Wife spoke briefly for the first time since the video, where the Husband explicitly clarified that his intention (niyyah) was never to divorce.
Current Situation (June/July 2026): The First Wife abandoned the Husband and left the country with their children. The Husband and the First Wife have now been separated and have not spoken or met in over 8 to 9 months. The Husband intends to divorce the First Wife. He and the Second Wife have reconnected, are currently in different countries, and desperately wish to resume their marriage.
The Context of Extreme Coercion: Actualized Harm, Not Baseless Fear
The video of the Talaq was extracted under severe, life-threatening circumstances. The threats the Husband faced were not empty; they were physically carried out. The First Wife comes from a very wealthy family, and her maternal uncle (Mamu) is a highly influential figure (believed to be a prominent attorney or judge). She weaponized this wealth and corrupt influence to orchestrate the following:
1. Imprisonment and Physical Beatings: The Husband was actually thrown into jail twice and was physically beaten. Tragically, the Husband's own father sided with the influential First Wife because of her financial status and actively facilitated getting his own son jailed to force his compliance.
2. Threats of Violence Against the Second Wife: The First Wife sent hired thugs/goons and the police after the Second Wife, threatening to have her beaten, raped, and tortured. Because the Second Wife does not come from money or power, she was entirely defenseless.
3. Destruction of Livelihood and Abandonment: Out of jealousy over the business the Husband and Second Wife had built together, the First Wife completely ruined their joint company, forcing the Husband to find a new job. Concurrently, the Husband's mother fell severely ill. The First Wife, motivated entirely by finances and backed by the Husband's wealthy father, completely abandoned the Husband and his sick mother. She dumped the entire burden of care onto the Husband, took the children to her home country, and cut off contact.
4. Weaponization of Children and Privacy: Before leaving, the First Wife threatened to permanently keep the children away from the Husband. She also obtained and distributed private, nude photographs of the Husband and the Second Wife to her family members and her lawyer as a blackmail tactic.
The Forced Wording & Coerced Witnesses
To make the forced divorce appear legitimate, the First Wife orchestrated the exact scenario of the video:
The Script: She forced the Husband to use specific wording in Urdu: "Main [Husband] [Second Wife] ko apne puray hosho hawas main Talaq deta hu talaq deta hu talaq deta hu."
The Coerced Witnesses: There were two witnesses present (employees of the Husband). However, both witnesses were also being actively blackmailed and coerced by the First Wife to participate. The entire setting was an extortion racket.
Because the Second Wife was completely isolated, terrified by the police presence, and cut off from communication, she initially accepted the situation out of severe confusion and despair, not knowing the full extent of the Husband's physical abuse and imprisonment until much later.
The Husband’s Intention (Niyyah)
The Husband maintains that his heart absolutely rejected the divorce. He only recorded the video because he had already been beaten, jailed, and cornered, and he was terrified for the Second Wife's physical safety and of losing his children. The pronouncement was a forced script and was done solely to neutralize an active, violent threat.
The Husband continually emphasizes this point to the scholars, asking: "If you cannot force anyone into accepting Islam, how can you forcefully end a relationship under such extreme duress?"
Our Questions for the Respected Council:
1. Given the actualized violence, imprisonment, physical beatings, extortion regarding the children, and the fact that the witnesses themselves were blackmailed, does this constitute extreme coercion (Ikrah) to the point of invalidating the Talaq completely?
2. Does the forced inclusion of the phrase "in my full senses" hold any weight when the surrounding context is one of undeniable, documented extortion and physical abuse?
3. Is the Nikkah from March 7, 2023, still intact, allowing the Husband and the Second Wife to simply resume the marriage?
4. If the divorce is somehow counted as valid, what are the exact steps required for them to legally reconcile under Shariah, considering the time that has passed?
5. If a new Nikkah is required, could you please provide specific guidance on the valid procedure for conducting a Nikkah over the phone or via video call, as they are currently residing in different countries?
We are in urgent need of a formal Fatwa regarding this matter and are fully willing to pay any required fees for your time and services. We are desperately seeking a peaceful, halal resolution to this nightmare and eagerly await your guidance rooted in the Qur'an and Sunnah.

الجواب وباللہ التوفیق

Although the husband experienced pressure and stress in the circumstances described, all three divorces pronounced by him will nevertheless be effective, and the marriage from 2023 is no longer valid.

As for remarriage, there is currently no possibility of doing so. The only exception is if the former wife marries another man, the marriage is consummated, and the second husband subsequently divorces her, or he passes away, and her ‘iddah is completed. In that case, she may marry her first husband again with a new mahr.

If the spouses wish to marry each other again and are in different countries, the proper procedure is for the husband to appoint someone near the wife as his wakil (representative). That representative may, on behalf of the husband, conduct the ijab and qabul with the woman in the presence of two witnesses, and the marriage will be valid. Alternatively, the wife may appoint a wakil near the husband and the marriage may be conducted in the same manner.

However, if the husband and wife conduct the ijab and qabul online, with the husband on one side and the wife on the other, such a marriage will not be valid, even if witnesses are present. This is because, for a marriage to be valid, the contracting parties, their representatives (wakils), and the two witnesses must be present in the same majlis (session/meeting).

صورت مسئولہ میں اگرچہ شوہر نے بہت سے اعتبارات سے دباؤ اور پریشر محسوس کیا لیکن اس کے باوجود اس کی جانب سے دی گئی تینوں طلاقیں  واقع ہوں گی، اور 2023 کا نکاح باقی نہیں رہا۔ جہاں تک دوبارہ نکاح کی بات ہے تو فی الحال اس کی کوئی گنجائش نہیں۔ الا یہ کہ دوسری بیوی کسی اور سے نکاح کرے اور وہ صحبت کے بعد طلاق د یدے یا اس کا انتقال ہو جائے اور اس کی عدت گزر جائے تو  شوہر اول سے جدید مہر کے ساتھ نکاح ہو سکتا ہے۔

 زوجین اگر دوبارہ نکاح کرنا چاہتے چاہیں اور الگ الگ ملکوں میں ہوں تو نکاح کا طریقہ یہ ہے کہ شوہر بیوی کے پاس کسی کو اپنا وکیل بنائے اور وہ شوہر کی طرف سے دو گواہوں کی موجودگی میں لڑکی سے ایجاب و قبول کر لے تو یہ نکاح منعقد ہو جائے گا۔ یا پھر بیوی شوہر کے پاس اپنا وکیل بنا کر مذکورہ طریقہ  کے مطابق نکاح کرے۔ دونوں اگر آن لائن ایجاب و قبول کرتے ہیں، ایک طرف شوہر اور دوسری طرف بیوی تو ایسا نکاح منعقد نہیں ہوگا۔ اگرچہ وہاں گواہ موجود ہوں، کیونکہ نکاح کے صحیح ہونے کے لیئے عاقدین اور ان کے وکیل اور دو گواہوں کا ایک مجلس میں ہونا ضروری ہے۔
