Working more than one job at the same time slot.

As salamu alekum warahmath-ullah wabarakatuh,

I work in a IT company which allows people to work from home between 7 am till 6 pm. Recently i have seen and experienced that some of my muslim coworkers have taken 1-2 jobs during the same time and get paid by 2-3 different companies.

After pandemic this has become very normal with most of the software professionals as they can work at multiple computers at the same time. They somehow lie if the meeting coincide and manage it. 

Also making double or triple the amount of salary that they use to make. Also paying taxes on them correctly. They attend the day job and complete the work in the offline hours after 7 pm. It is permissible ti work this way. Will the income be halal? Also if i come to know how should i deal with it.

If your colleagues are time bound by the company, i.e., work on (time based) basis,i.e, they have been scheduled to work in the office from 8 am to 5pm, or the company stipulates that their employees cannot be employed by another company, it is then not permissible for them to work elsewhere while employed by that company.

Working for another company in parallel is not permissible without express permission of the original company.Therefore, the time spent on working for the other company and the wages earned for that time period are not allowed.

If your original company has employed you on project-based basis, whereby your responsibility is to complete the project and hand it over to the company without their time control, that kind of agreement will allow you to work in parallel for another company and will make your job legitimate. Or if the second job is being done outside of the company hours, the employment of the original company as well as of the second company shall be permissible. 

Regarding your concerns of responsibility, your obligation is only to inform them of the legal position of the situation and convince them to avoid unlawful earnings. But if they do not heed to it, then you will be absolved of any responsibility.

والأجیر الخاص ہو الذي یستحق الأجرۃ بتسلیم نفسہ في المدۃ، وإن لم یعمل کمن استأجر رجلا شہرا للخدمۃ، أو لرعي الغنم، وإنما سمي خاصا؛ لأنہ یختص بعملہ دون غیرہ؛ لأنہ لا یصح أن یعمل لغیرہ في المدۃ۔ (الجوہرۃ النیرۃ، کتاب الإجارۃ، مکتبہ دارالکتاب دیوبند ۱/ ۳۱۳، إمدادیہ ملتان ۱/ ۳۲۳)

(وَالثَّانِي) وَهُوَ الْأَجِيرُ (الْخَاصُّ) وَيُسَمَّى أَجِيرَ وَحْدٍ (وَهُوَ مَنْ يَعْمَلُ لِوَاحِدٍ عَمَلًا مُؤَقَّتًا بِالتَّخْصِيصِ وَيَسْتَحِقُّ الْأَجْرَ بِتَسْلِيمِ نَفْسِهِ فِي الْمُدَّةِ وَإِنْ لَمْ يَعْمَلْ كَمَنْ اُسْتُؤْجِرَ شَهْرًا لِلْخِدْمَةِ أَوْ) شَهْرًا (لِرَعْيِ الْغَنَمِ) الْمُسَمَّى بِأَجْرٍ مُسَمًّى بِخِلَافِ مَا لَوْ آجَرَ الْمُدَّةَ بِأَنْ اسْتَأْجَرَهُ لِلرَّعْيِ شَهْرًا حَيْثُ يَكُونُ مُشْتَرَكًا إلَّا إذَا شَرَطَ أَنْ لَا يَخْدُمَ غَيْرَهُ وَلَا يَرْعَى لِغَيْرِهِ فَيَكُونُ خَاصًّا وَتَحْقِيقُهُ فِي الدُّرَرِ وَلَيْسَ لِلْخَاصِّ أَنْ يَعْمَلَ لِغَيْرِهِ، وَلَوْ عَمِلَ نَقَصَ مِنْ أُجْرَتِهِ بِقَدْرِ مَا عَمِلَ فَتَاوَى النَّوَازِلِ(رد المحتار:۶/۶۹)

مَنْ رَأَى مُنْكَرًا فَلْيُنْكِرْهُ بِيَدِهِ، وَمَنْ لَمْ يَسْتَطِعْ فَبِلِسَانِهِ، وَمَنْ لَمْ يَسْتَطِعْ فَبِقَلْبِهِ، وَذَلِكَ أَضْعَفُ الإِ
