Contraception option

Sallams, I am unexpectedly pregnant for the 6th time, as a result of failed birth control (barrier method). I have tried hormonal birth control in the past in the form of pills and iud and it just did not work well at all with my body and hormones that I needed to immediately remove them. I am prone to anemia and do not want to get the non hormonal iud as it is known to cause very heavy bleeding, so for my health it is not good. I am 37, and my doctor has now warned me that since I am over the age of 35, and because my body is giving birth to more than 4 children,  I am at a high risk for postpartum hemmorhage which can lead to maternal death during delivery. This very much scared me. I am praying this will be a smooth pregnancy and delivery but I do not want to risk my chances again after this. Can I proceed with a tubal ligation that is still considered reversible with a surgery after I deliver this baby (inshallah safely)? I do not want to be at high risk with another pregnancy and want to be there for my children and husband inshallah, and since other birth control forms will not work well for me, I’d like to know if I am okay to proceed with this type of birth control procedure shortly after delivery inshallah? Please advise. Jazakallah khairan

A permanent contraceptive operation that results in a woman permanently losing her ability to bear children is not permissible according to Islamic law, as it is contrary to the objectives of the Shariah.

However, if pregnancy would pose a serious risk to the woman's health or endanger her life, then there is no objection to using temporary methods of contraception. Since tubal ligation (female sterilization) is a permanent method of preventing pregnancy, it is not permissible under normal circumstances.

In the present case, if there is a genuine medical reason—such as a serious illness, severe physical weakness, or a real risk associated with a future pregnancy or childbirth—then it is permissible to adopt temporary contraceptive measures that can later be discontinued, allowing childbearing to resume if desired.

Therefore, having the fallopian tubes tied (tubal ligation) is not permissible, whereas using temporary contraceptive methods to prevent pregnancy is permissible when there is a valid medical or Shar‘i reason.

 

منعِ حمل کے لیے ایسا آپریشن جس کے نتیجے میں عورت کی تولیدی صلاحیت (بچہ پیدا کرنے کی قدرت) مستقل طور پر ختم ہو جائے، شرعاً جائز نہیں اور شریعت کے منشا کے خلاف ہے۔ البتہ اگر حمل کی صورت میں عورت کی صحت کو شدید نقصان پہنچنے یا جان کو خطرہ لاحق ہونے کا اندیشہ ہو، تو عارضی طریقۂ منعِ حمل اختیار کرنے میں کوئی حرج نہیں۔ ٹیوب لائگیشن (Tubal Ligation) یا نس بندی چونکہ حمل روکنے کا ایک مستقل طریقہ ہے، اس لیے شرعاً اس کی اجازت نہیں۔  صورت مسئولہ میں اگر واقعتاًکوئی عذرہو یعنی  عورت کو کوئی بیماری، شدید کمزوری یا آگے بچے کی پیدائش میں کسی قسم کا خطرہ ہو وغیرہ،توایسی صورت میں ایسےمانع ِحمل تدبیروں کو اپنانے کی گنجائش ہے، جو وقتی ہوں، اور جب چاہیں اُنہیں ترک کرکے توالد وتناسل کا سلسلہ جاری کیا جاسکتا ہو،لہذا  بچہ دانی بند کروانا تو جائز نہیں ہے، البتہ ایسی  عارضی احتیاطی تدابیر اختیار کرسکتی ہیں کہ جس سے حمل ہی نہ ٹھہرے ۔

فی عمۃ القاری شرح صحیح البخاری: "فإن الاختصاء في الاٰدمي حرام."

و فی فتاوی الشامی: '(ويعزل عن الحرة) وكذا المكاتبة نهر بحثا (بإذنها).'

و فیہ ایضاً :

" أخذ في النهر من هذا ومما قدمه الشارح عن الخانية والكمال أنه يجوز لها سد فم رحمها كما تفعله النساء."

فتاوی ہندیہ میں ہے:

و فی فتاو الھندیۃ "العزل ليس بمكروه برضا امرأته الحرة."
